3. Website Use

Customers using Innvikta's cybersecurity platform agree to obtain all necessary permissions before uploading employee or organizational data, conduct phishing simulations responsibly and ethically, comply with applicable employment, privacy, and cybersecurity laws, ensure administrators manage user permissions securely, and use the platform only for legitimate cybersecurity awareness purposes.
6. Intellectual Property
Unless otherwise stated, all intellectual property rights relating to the website and Services, including software, source code, training content, graphics, designs, documentation, videos, logos, trademarks, reports, AI-generated templates, and educational resources, remain the exclusive property of Innvikta or its licensors.
You may not reproduce, distribute, modify, sell, sublicense, reverse engineer, or create derivative works without prior written permission.
7. AI-Powered Features
Innvikta may provide AI-powered capabilities including phishing email generation, landing page generation, campaign recommendations, human risk scoring, awareness content generation, and reporting insights.
AI-generated content is intended to assist users and should be reviewed before deployment. Customers remain responsible for ensuring compliance with organizational policies and applicable laws.
8. Privacy
Your use of our Services is also governed by our Privacy Policy. By using the Services, you acknowledge that your information may be processed in accordance with our Privacy Policy.
9. Third-Party Services
The website or platform may integrate with third-party services including analytics providers, email platforms, authentication providers, cloud infrastructure, or productivity applications. Innvikta is not responsible for the availability, security, or content of third-party services.
10. Availability of Services
We strive to maintain uninterrupted Services; however, we do not guarantee continuous availability. Services may be temporarily unavailable due to scheduled maintenance, security updates, infrastructure failures, internet disruptions, third-party service outages, or force majeure events.
11. Payments
Where applicable, subscription fees are governed by the applicable quotation, proposal, purchase order, or service agreement, payments must be made according to agreed payment terms, taxes and government charges are the responsibility of the customer unless otherwise specified, and failure to pay may result in suspension or termination of Services.
12. Confidentiality
Both Innvikta and the customer agree to maintain the confidentiality of proprietary or confidential information exchanged during the course of providing the Services, except where disclosure is required by law.
13. Disclaimer
The Services are provided on an “as is” and “as available” basis.
While Innvikta is designed to improve cybersecurity awareness and reduce human risk, we do not guarantee that use of the Services will prevent every phishing attack, cyber incident, malware infection, or data breach. To the maximum extent permitted by law, all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, are excluded.
14. Limitation of Liability
To the fullest extent permitted by law, Innvikta shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, loss of profits, business interruption, loss of data, loss of goodwill, or reputational damage.
Where liability cannot legally be excluded, Innvikta's total liability shall not exceed the fees paid by the customer for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.
15. Indemnification
You agree to indemnify and hold harmless Innvikta, its directors, officers, employees, affiliates, and partners from any claims, liabilities, damages, losses, or expenses arising from your misuse of the Services, your breach of these Terms, your violation of applicable laws, or your infringement of any third-party rights.
16. Suspension and Termination
Innvikta may suspend or terminate access to the Services if these Terms are violated, payment obligations are not fulfilled, continued access poses a security risk, it is required by law or regulatory authorities, or it is requested by an authorized customer administrator. Upon termination, your right to use the Services immediately ceases.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India, unless otherwise agreed in writing.
18. Changes to These Terms
Innvikta reserves the right to update or modify these Terms at any time. Any changes will become effective upon publication on this page. Continued use of the website or Services after such changes constitutes acceptance of the revised Terms.
